Ahhhscend Creator - Seller Agreement

Effective Date: June 12, 2026

Welcome to Ahhhscend. We are honored to support Creators/Sellers in sharing their gifts, services, products, events, programs, experiences, communities, and offerings with Seekers/Buyers around the world.

By creating a Creator account, activating a Creator Access Pass, posting listings, or conducting business through Ahhhscend, you agree to the terms of this Creator/Seller Agreement.

1. Definitions

Sellers|Creators are individuals or businesses offering products, services, sessions, events, courses, programs, communities, digital products, or other offerings through Ahhhscend.

Buyers|Seekers are individuals who browse, purchase, book, register for, participate in, or otherwise engage with offerings available through Ahhhscend.

2. Purpose of Ahhhscend

Ahhhscend exists to create a place where people feel encouraged into a bigger life-to help people move toward bigger dreams, richer experiences, and lives that feel more alive.

Creators/Sellers are expected to contribute to this mission through ethical, respectful, and professional interactions with Seekers/Buyers and fellow Creators|Sellers.

3. Creator|Seller Responsibilities

Creators|Sellers are solely responsible for:

The accuracy of their listings
Communications with Seekers/Buyers
Delivery and fulfillment of offerings
Compliance with applicable laws and regulations
Maintaining any licenses, certifications, permits, or insurance required for their offerings
Managing their business practices and customer relationships

Ahhhscend is not responsible for a Creator|Seller's business operations, obligations, or fulfillment responsibilities.

4. Listing Accuracy

Creators | Sellers agree to:

Provide truthful and accurate information
Use clear descriptions
Accurately represent qualifications, experience, and credentials
Disclose limitations, prerequisites, requirements, restrictions, and important details
Maintain current pricing and availability information

Listings that are misleading, deceptive, fraudulent, or intentionally inaccurate may be removed at Ahhhscend's discretion.

4.1 External Links & Off-Platform Transactions

To protect the integrity of the Ahhhscend marketplace and ensure a consistent experience for all users, Creators may not include external checkout links, affiliate links, payment links, or other links intended to direct Seekers - Buyers to complete transactions outside of the Ahhhscend platform.

Creators may share information about their offerings within their listings, but may not use listings, messages, profiles, or other platform features to intentionally bypass Ahhhscend's transaction process or fees.

Ahhhscend reserves the right to remove content, suspend listings, or take other appropriate action when external links are used in a manner that circumvents the platform's intended transaction process.

5. Respectful Conduct

Creators/Sellers agree to:

Treat Seekers/Buyers with respect
Communicate professionally
Honor commitments whenever reasonably possible
Provide a positive customer experience
Avoid harassment, discrimination, intimidation, threats, or abusive behavior

Ahhhscend reserves the right to suspend or remove Creators/Sellers whose conduct negatively impacts the safety, trust, or integrity of the platform.

6. Spiritual Wellness, Coaching, and Personal Growth Offerings

Many Ahhhscend Creators/Sellers offer services related to personal growth, spirituality, coaching, wellness, energy work, intuitive guidance, education, and related fields.

Creators/Sellers understand and agree that:

They are solely responsible for the claims and representations made regarding their offerings.
They may not guarantee specific outcomes, healing, earnings, relationship results, manifestations, spiritual experiences, or other results.
They may not present offerings as medical, psychological, legal, financial, or other licensed professional advice unless they are properly qualified and legally authorized to do so.
They must clearly communicate the nature and scope of their offerings.

Seekers/Buyers remain responsible for their own decisions, actions, participation, and outcomes.
Ahhhscend does not verify, endorse, evaluate, certify, or guarantee the qualifications, training, experience, methods, advice, services, claims, or outcomes offered by any Creator/Seller. Seekers/Buyers participate in offerings at their own discretion and assume responsibility for their own decisions and experiences.

7. Subscription — Creator Access Pass

Creator features require an active Creator Access Pass subscription.

Failure to maintain an active Creator Access Pass may result in:

Restricted posting privileges
Listing limitations
Suspension of Creator features
Removal of access to certain platform benefits

Subscription fees are non-refundable except where required by law.

8. Products, Services, and Fulfillment

Creators/Sellers are responsible for fulfilling all purchases and commitments made through the platform.

This includes, but is not limited to:

Delivering products
Providing services
Conducting sessions
Hosting events
Delivering digital products
Managing communities
Honoring commitments made within listings

Failure to fulfill purchased offerings may result in listing removal, account review, suspension, termination, or other actions deemed appropriate by Ahhhscend.

Creators/Sellers are responsible for monitoring platform messages and responding promptly to inquiries, purchases, booking requests, fulfillment requirements, and customer communications.

Certain offerings may require additional communication between Creators/Sellers and Seekers/Buyers to complete scheduling, customization, delivery, fulfillment, or other transaction-related details.

9. Payments and Payouts

Payments are processed through third-party payment providers [Stripe].

Creators/Sellers acknowledge and agree that:

Ahhhscend does not directly process payment information.
Payout timing may depend on platform processes and third-party payment providers.
Transaction fees may apply.
Ahhhscend may delay, withhold, or restrict payouts when necessary to investigate fraud, abuse, chargebacks, disputes, policy violations, or other legitimate concerns.

10. Refunds and Cancellations

Creators/Sellers are responsible for clearly communicating refund, cancellation, transfer, rescheduling, and related policies within their listings whenever applicable.

Where no policy is stated, Ahhhscend may review disputes and circumstances on a case-by-case basis.

11. Intellectual Property

Creators/Sellers retain ownership of the content they create and upload.

By posting content on Ahhhscend, Creators|Sellers grant Ahhhscend a non-exclusive, worldwide, royalty-free license to:

Display listings
Promote listings
Market the platform
Share Creator/Seller content within Ahhhscend-related communications and promotional materials

Creators|Sellers represent that they have the necessary rights to all uploaded content.

12. Marketplace Relationships

Creators|Sellers understand that Ahhhscend serves as a marketplace platform connecting Creators|Sellers and Seekers/Buyers.

Unless expressly stated otherwise:

Ahhhscend is not a party to agreements between Creators/Sellers and Seekers/Buyers.
Ahhhscend does not guarantee sales.
Ahhhscend does not guarantee customer acquisition.
Ahhhscend does not guarantee business success.
Ahhhscend does not guarantee specific outcomes from participation on the platform.

13. Prohibited Activities

Creators|Sellers may not:

Engage in fraud, deception, or misrepresentation
Post illegal content
Infringe on intellectual property rights
Harass, threaten, or abuse users
Manipulate reviews or ratings
Circumvent platform payment systems
Misrepresent qualifications or credentials
Use Ahhhscend for unlawful activities

Violations may result in immediate suspension or termination.

14. Platform Features and Limitations

Creators|Sellers acknowledge that platform features, tools, listing options, booking systems, customization options, delivery methods, and transaction processes may evolve over time.

Certain product variations, customization requests, scheduling arrangements, delivery methods, or fulfillment processes may require direct communication between Creators/Sellers and Seekers/Buyers through the platform messaging system.

Creators|Sellers are responsible for reviewing platform instructions, updates, and guidance related to platform functionality.

15. Disputes and Resolution

Creators|Sellers agree to make reasonable efforts to resolve concerns, misunderstandings, cancellations, fulfillment issues, scheduling conflicts, and customer service matters directly with Seekers|Buyers whenever possible.

In the event of a dispute, Ahhhscend may, at its sole discretion, review communications, transaction records, listing details, and other relevant information to better understand the circumstances.

Creators|Sellers agree to cooperate with reasonable requests for information during such reviews.

Ahhhscend reserves the right to take actions it deems appropriate to protect the integrity of the platform, including:

Issuing warnings
Removing listings
Restricting account privileges
Suspending accounts
Withholding payouts where permitted by law
Terminating accounts for policy violations

Creators|Sellers acknowledge that Ahhhscend is not obligated to mediate disputes between Creators|Sellers and Seekers/Buyers and is not responsible for the actions, omissions, products, services, representations, or conduct of either party.

Any formal dispute resolution procedures, arbitration provisions, governing law provisions, limitations of liability, or related legal terms are governed by the Ahhhscend Terms of Service, which are incorporated into this Agreement by reference.

16. Good-Faith Resolution

Creators/Sellers agree to approach disputes, misunderstandings, and customer concerns in good faith and with a genuine effort to find fair and reasonable solutions whenever possible.

Ahhhscend encourages communication, professionalism, mutual respect, and practical problem-solving before escalation to formal dispute processes.

17. Collaboration and Community Standards

Ahhhscend is founded on the belief that Creators|Sellers thrive through collaboration, encouragement, and mutual support rather than competition alone.

Creators/Sellers agree to engage with the community in a manner that supports:

Integrity
Respect
Inclusion
Constructive communication
Professional conduct

While healthy business competition is expected, behavior intended to undermine, harass, intentionally damage, or interfere with other Creators|Sellers may result in review of Creator/Seller privileges.

18. Account Suspension and Termination

Ahhhscend may suspend, limit, or terminate Creator|Seller accounts that:

Violate this Agreement
Violate the Terms of Service
Create risk to Seekers/Buyers or the platform
Engage in fraudulent, abusive, deceptive, or harmful behavior

Termination decisions are made at Ahhhscend's sole discretion.

19. Limitation of Liability

To the fullest extent permitted by law, Ahhhscend shall not be liable for:

Lost income
Lost profits
Lost business opportunities
Indirect or consequential damages
Disputes between Creators/Sellers and Seekers/Buyers
Service interruptions
Third-party payment processor issues
User conduct or actions

20. Creator|Seller Responsibility and Indemnification

Creators|Sellers are solely responsible for the products, services, sessions, events, courses, programs, communities, digital products, advice, information, and other offerings they provide through Ahhhscend

Creators/Sellers acknowledge and agree that Ahhhscend does not create, manufacture, inspect, supervise, endorse, guarantee, control, or assume responsibility for any Creator/Seller offering

Creators|Sellers further agree that they are solely responsible for:

The safety of their offerings
The accuracy of representations made in listings
Compliance with applicable laws and regulations
Obtaining any licenses, permits, certifications, or insurance required for their offerings
The conduct of their business activities
Any injuries, losses, damages, claims, liabilities, disputes, or legal actions arising from their offerings
To the fullest extent permitted by law, Creators|Sellers agree to defend, indemnify, and hold harmless Ahhhscend, its owners, operators, employees, contractors, affiliates, successors, and representatives from and against any claims, demands, actions, damages, liabilities, losses, costs, expenses, judgments, settlements, or attorney fees arising from
Their products, services, sessions, events, programs, courses, communities, or other offerings
Their acts or omissions
Their violation of laws, regulations, or third-party rights
Their breach of this Agreement or the Terms of Service
Any dispute between the Creator/Seller and a Seeker/Buyer
This obligation survives account termination and continued use of the platform

21. Agreement Updates

Ahhhscend may update this Creator|Seller Agreement from time to time.

Continued use of Creator|Seller features after updates constitutes acceptance of the revised Agreement.
